Summary

H&S legal duties explained: investigations, court procedure and consequences, led by regulatory law expert Karen Railton.

The course will provide an overview of individual and corporate duties under H&S law and what happens should you breach your duty?

We will consider the implications of an accident in relation to these duties and follow that from investigation to court proceedings and potential consequences.

Our speaker Karen Railton is a Partner and Head of the Regulatory SHE Advisory Team in Scotland at DAC Beachcroft. She specialises in the defence of individuals and organisations in relation to Health & Safety investigations and prosecutions. She has over 19 years’ experience advising clients across a range of sectors including construction, manufacturing, healthcare, transport and logistics, and public sector.

Karen has represented accused organisations, individuals and interested parties on high profile complex matters including the Fatal Accident Inquiry into the death of Shea Ryan who tragically slipped whilst climbing down a manhole on a construction site in Glasgow, and the Fatal Accident Inquiry following the Carmont Train derailment.

In addition to defending cases in Court, Karen regularly delivers training and presentations on all aspects of Health & Safety law to Corporate Organisations and also at sector events, presenting annually at HSM Live amongst others. She is a member of the Health & Safety Lawyers Association.
