Co-hosted with Marsh (Hong Kong) Limited and PolyU SPEED, this CPD session examines the liability risks construction professionals, project teams, consultants, contractors, and decision-makers may face in Hong Kong, and how these risks relate to contractual obligations, professional indemnity insurance, and management liability insurance.
The session will focus on real areas of exposure in construction, including design responsibility in design-and-build projects, collateral warranties, third-party claims, joint and several liability, indemnity clauses, fitness-for-purpose obligations, health and safety accountability, regulatory investigations, and insurance coverage gaps.
What this session offers
- Understand how professional indemnity risks arise in construction projects, including design responsibility creep, collateral warranties, third-party claims, and joint and several liability.
- Identify common mismatches between contract obligations and insurance cover, including indemnity clauses that exceed policy limits, fitness-for-purpose requirements, exclusions, and retroactive or run-off cover issues.
- Learn when construction leaders, senior management, and decision-makers may face personal exposure, including insolvency, wrongful trading, health and safety, and regulatory investigation risks.
- Recognise frequent professional indemnity claim triggers in Hong Kong construction projects and the coverage limitations that may affect claims.
- Review practical risk mitigation steps, including key contract clauses to check, governance controls to strengthen, and questions to ask brokers and legal advisors before problems arise.
