Extension of Time Entitlement During Contractor Delay: A Causation Approach

Summary

This CIOB CPD session examines whether a Contractor is entitled to an Extension of Time when an Employer instruction or variation is issued during a period of Contractor-caused delay. Presented as a structured debate from both the Employer and Contractor perspectives, the session explores contractual causation, concurrency, prevention and critical path delay through practical scenarios. Attendees will consider the distinction between an instruction that is absorbed within existing delay and one that genuinely drives the prevailing completion date. The session will provide a practical framework for assessing EOT entitlement, including the use of contemporaneous programmes, the net delay approach, recovery opportunities and subsequent review against the as-built record.

Presenters

Feras Al Roumani is a Managing Director at HKA, Delay Expert and RICS Accredited Expert Witness based in Saudi Arabia. A qualified Civil Engineer with over 29 years of experience, he specialises in claims and dispute resolution, forensic delay analysis, project controls, contract management and arbitration support across major projects in the Middle East, Africa and Asia.

Stephen Cochrane is an Associate Director at HKA and a planning and delay specialist with 19 years of experience supporting employers, contractors and consultants. He holds BEng, MSc and LLM degrees, is a Fellow of the Chartered Institute of Arbitrators, and is a Member of the Chartered Institute of Building and the Society of Construction Law. His experience includes preparing and assessing complex EOT claims and supporting expert witness work in arbitration.
