Accrual of causes of action, limitation periods and conditions precedent

The talk will look at legal issues that need to be addressed in order for the claims of any party to be capable of being successfully passed up or down the contractual chain. This will include consideration of when a cause of action arises (whether in contract or tort), whether or not the making of any such claims are subject to conditions precedent (and the consequences of any failure to so comply), and the effect of any applicable limitation periods for liability, particularly in light of the recent judgment in the Victoria Square apartments case.

Speaker: Tim Kinney, Head of Construction & Projects, Tughans
Tim has specialised as a construction lawyer for over 25 years and he is qualified as a solicitor in Northern Ireland, England & Wales and Ireland. Tim has advised both public and private sector clients on major construction/infrastructure projects in the UK and Ireland, across a range of sectors, including: energy; waste; retail; transport; utilities; telecommunications; hospitality; health; and, student accommodation. He advises on all forms of construction and engineering contracts, sub- contracts and consultancy agreements and also on dispute resolution matters across all three jurisdictions. He has an MSc in Construction Law and Arbitration (Kings College, London) and he is also an accredited mediator.

Grainne qualified into Tughans’ dispute resolution team in 2017 having completed her training contract with Tughans. Grainne is qualified in NI, ROI and E&W and practices primarily in construction. Grainne has broad experience in advising clients in a range of commercial disputes including professional negligence and breach of contract claims, with a particular focus on construction disputes including adjudications. Grainne acts for Employers, Contractor’s and Sub-contractors in payment disputes, defects claims and delay and disruption disputes. Grainne also advises on non-contentious construction matters across sectors such as transport, utilities, infrastructure, telecommunications and residential & commercial development.
